At Learning By Design, Inc. (a Delaware corporation with its headquarters located in Evanston, IL) we respect the privacy of our website visitors and our customers. We do not sell your information to third parties. If we collect data, including email addresses, when you contact us or opt-in for any of our products or services, we keep your information private. We do not collect information from children.

The following statement outlines our privacy policy in more detail. The policy applies to learningbydesign.com, spell-links.com, and the SPELL-Links WordUP! app. Our websites are for adults and our apps are directed at adults or children with adult supervision. We take privacy seriously and this policy is designed to tell you what information we collect and how we use it.

We last updated this policy on March 29, 2019. Please review this policy from time to time as we may make changes. If there are any changes to this policy in the future, that information will be posted here. You will be notified by a notice on our site of any material changes made to this policy. What kind of information is collected?

There are two types of data that websites and apps can collect about their users. The first one is called personal data. This is Personally Identifiable Information that identifies a user as an individual. Our websites and apps do not collect any information from children unless you enter and send us that information. The use of our websites and apps is voluntary and you always have the option to de-identify data collected from children before sending it to us. There are no push notifications in our apps and we do not collect geolocation information. We may collect personal information that educators and parents voluntarily provide on our websites, such as when requesting product samples and other types of information, subscribing to mailing lists and online services, and purchasing books, software, apps, or other materials or services from our website.

The second type is non personal data which doesn’t directly identify an individual. Learning By Design, Inc. may collect non personal information about the use of the websites and apps to help us improve our services. This may include traffic data and analytics, cookies, and similar technologies. These data are used to gather general statistics about our customers and visitors. We may use non personal information to generate collective information about our users, but not in a way that identifies any user specifically. For example, we may inform third parties about the number of registered users and unique visitors, and the pages most frequently browsed.

How Do We Use the Information We Collect?

We use information we collect to communicate with you, process your orders and requests for services, provide technical support, facilitate your transactions with our third-party partners and providers, research how to improve our product and service offerings, and inform you of news, products, services, offers and discounts.
We do not sell the information that you provide us to any third parties.

We share customer information with third parties only as follows:

Order Processing. Learning By Design, Inc. may use your Personally Identifiable Information to process your payment through merchant account services, and to generate and deliver the products and services you order. Your Contact Data may be used to follow up with you on transactions you initiate, respond to inquiries, inform you of changes to products and services you have purchased, and send you additional information about Learning By Design, Inc. and its products and services.

Service and Technology Providers. We may share your Personally Identifiable Information with companies that provide support services to us, help us market our products and services, or for training purposes (e.g., email service provider, online survey providers, email marketing providers, online meeting and webinar providers, listserv providers, social network providers, cloud storage providers). These companies may need information about you in order to perform their functions. These companies are not authorized to use the information we share with them for any other purpose.

Business Partners. When you purchase a product or service from us that is procured from one of our business partners, we will share your Personally Identifiable Information with those business partners so that they can provide you with the product or services included with your purchase. These companies are not authorized to use the information we share with them about you for their own marketing purposes without first asking for your permission.

Listservs, Blogs, Forums. Learning By Design, Inc. offers publicly accessible listservs, blogs, and interactive forum, including SPELLTalk and SPELL-Link’d, through third party technology providers. We share your Personally Identifiable Information with those business partners so that you can receive the listserv, blogs, interactive forum services. You should be aware that any information you provide in these areas may be read, collected, used and shared by others who access them. You should use caution when deciding whether to disclose your personal information in these areas of the site. We may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Other Transfers. We may share Personally Identifiable Information and other data with businesses controlling, controlled by, or under common control with Learning By Design, Inc. If Learning By Design, Inc is merged, acquired, or sold, or if some or all of our assets or equity are transferred, we may disclose or transfer Personally Identifiable Information and other data in connection with the associated transactions.

Required by Law. We may also disclose your personal information: as required by law, such as in response to a subpoena, a lawful request by a public authority, including to meet national security or law enforcement requirements, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a legal request.

Letters, Pictures, and Stories

Parents: Learning By Design, Inc. does not seek personal information from children. If you choose to send us letters, pictures, or stories regarding your child’s success with Learning By Design, Inc. products and services we may share this information on our websites or via our social media platforms. If we show a photo or video of your child, we will share first name only. Because we value your privacy, and the privacy of your children, we will keep any other information you provide confidential, unless we have your express permission. Please note that if a parent posts personal information about themselves or their children in a community forum or on a social media site such as Facebook or Twitter, in addition to being collected, this data is made public for others to see. The parent is responsible for disclosing this data.

Professionals: Learning By Design, Inc. does not seek personal information from children. If you choose to send us letters, pictures or stories regarding your students’ success with Learning By Design, Inc. products and services we may share this information on our websites or via our social media platforms. However, because we value the privacy of all children, we will not share letters, stories, photos or videos of a child if it includes the child’s face or any other information that personally identifies the child. Please note that if a professional posts personal information about themselves or information about their students in a community forum such as SPELLTalk or SPELL-Link’d or on a social media site such as Facebook or Twitter, in addition to being collected, this data is made public for others to see. The professional is responsible for adhering to professional code of ethics, HIPPA laws, and the like.

Student Data and Student Work

Our websites do not collect any information from children unless you enter and send us that information. The use of our websites is voluntary and you always have the option to de-identify data collected from children before sending it to us.

We do not collect and store any personal information when children and others use our WordUP! app.

Surveys, Contests, and Prizes

We may provide you the opportunity to participate in surveys, on our site or through a 3rd party technology provider (e.g., Survey Monkey), to measure customer satisfaction. If you participate, we may request certain personally identifiable information from you. Participation in these surveys is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes name, email address, work setting, professional title. We do not sell the information that you provide us to any third parties.

We may provide you the opportunity to participate in contests and other activities that offer the opportunity to win a prize to promote our products and services. If you participate, we may request certain personally identifiable information from you. Participation in these contests and other activities is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes name and email address, work setting, professional title, and phone number. We use this information to notify you if you win and delivering your prize to you, to monitor site traffic or personalize the site, and/or to send participants emails with news, special offers, discounts and more. In the event that you win a prize, we may request your permission to publicly announce your name, professional title, and work setting as a winner but will not share any other personal data with our customers. We do not sell the information that you provide us to any third parties.

Learning By Design, Inc. may place an electronic “cookie” in the browser files of a guest’s computer. Cookies are pieces of information that a website transfers to an individual’s computer hard drive for record-keeping purposes. Cookies themselves do not enable us to access any personal information about our visitors; however, they do allow Learning By Design, Inc. to analyze guests’ use of our sites. Learning By Design, Inc. uses generally accepted security measures and safeguards in an attempt to keep the data it collects secure. The measures and safeguards include limiting access to the data to those persons who need it to complete their work for Learning By Design, Inc. and storing personal information in secure operating environments. That said, Learning By Design, Inc. cannot and does not guarantee and does not accept liability for unintentional disclosure.

The privacy of communication over the Internet cannot be guaranteed, because the Internet is not a secure medium. Learning By Design, Inc. does not assume any responsibility for any harm, loss, or damage you may experience or incur by the sending of personal or confidential information over the Internet by or to Learning By Design, Inc.

How to update or remove your information

Learning By Design, Inc. keeps your content for as long as necessary in providing the services. You can self-manage the types of emails and communications you receive from us by removing yourself from one or more of our mailing lists and networks (e.g., SPELLTalk, Active Campaign, SPELL-Link’d) by using the opt-out option that is unique to each mailing list or network from which you’d like to be removed. These opt-out options are included with any email you receive from us or within the network platform itself.
